Invalidation from healthcare practitioners is an experience shared by many patients, especially those marginalized or living with contested conditions (e.g., chronic pain, fibromyalgia, etc.). Invalidation can include not taking someone’s testimony seriously, imposing one’s thoughts, discrediting someone’s emotions, or not perceiving someone’s testimony as equal and competent. Epistemic injustices, that is, the disqualification of a person as a knower, are a form of invalidation. Epistemic injustices have been used as a theoretical framework to understand invalidation that occurs in the patient-healthcare (...) provider relationship. However, to date, the different recommendations to achieve epistemic justice have not been listed, analyzed, nor compared yet. This paper aims at better understanding the state of the literature and to critically review possible avenues to achieve epistemic justice in healthcare. A systematic and critical review of the existing literature on epistemic justice was conducted. The search in four databases identified 629 articles, from which 35 were included in the review. Strategies to promote epistemic justice that can be applied to healthcare are mapped in the literature and sorted in six different approaches to epistemic justice, including virtuous, structural, narrative, cognitive, and partnership approaches, as well as resistance strategies. These strategies are critically appraised. A patient partnership approach based on the Montreal Model, implemented at all levels of healthcare systems, seems promising to promote epistemic justice in healthcare. (shrink)

Cet article fournit les principaux résultats de la mission effectuée en mai 2011 dans le cadre du projet concernant la sculpture architecturale byzantine de la côte occidentale de la mer Noire. La première partie présente et décrit les ensembles architecturaux d’où proviennent les sculptures sur lesquelles ont été prélevés des échantillons de marbre. La seconde partie a trait aux caractéristiques spécifiques des marbres analysés : vingt échantillons de marbre prélevés sur des sculptures provenant surtout de Sozopol, mais aussi d’Obzor et (...) de Pomorie, ont été analysés afin de connaître leur provenance. Les différentes méthodes d’analyses ont montré que la majorité des échantillons étaient issus de l’île de Proconnèse. Néanmoins, quatre des vingt échantillons présentent une composition minéralogique et chimique différente de celle des marbres de Proconnèse : deux sont en marbre pentélique, un autre en marbre de Thasos et le dernier est très probablement en marbre local. Newton’s famous Hypotheses non fingo raises many questions. While he castigated the Cartesians for their vortex hypothesis, and his follower Cotes attacked mechanical chemistry, Newton himself ventured many hypotheses, notably in his Opticks, the Queries to the Opticks and in the last book of the Principia. Although it is true that Newton, unlike Descartes, fit his data to mathematical models, what he said about hypotheses seems straightforwardly false. To explain this situation, Wilson explores the web of associations between Cartesianism, hypotheses, (...) ‘speculation’ and ‘vain philosophy’ in the Pauline sense. She shows how Cartesian hypotheses concerning the origins of the world were understood as dangerously pagan, and how Newton and his supporters took pains to distinguish their brand of science from his by denying that they were engaged in any form of speculative or ‘vain’ philosophy. Les auxiliaires modaux anglais sont généralement présentés comme la prise en charge subjective de l’énoncé. Cela complète avantageusement les catégories logiques classiques par la prise en compte de faits axiologiques et intersubjectifs. Cependant, s’il n’y a que des prises en charge subjectives, comment expliquer en contrepartie l’objectivité relative du sémiotique? Cet article essaie d’apporter des réponses en évitant la circularité de l’histoire ou de la convention. L’objectivité n’est pas un héritage du passé, mais un produit de l’activité communicationnelle en contexte (...) présent. Il convient donc de distinguer soigneusement l’interprétation subjective du signe en contexte effectif de sa construction et de son adaptation dans la langue. Une définition dynamique du système du langage telle que la propose la Théorie de la Relation Interlocutive (Douay & Roulland 2014) permet d’expliquer ensemble et de relier les deux versants de l’Acte de langage, l’usage d’un côté et la construction systémique de l’autre. Nous nous sommes proposés ici de montrer qu’Aristote caractérise le fou (μαινόμενος) dans le cadre d’un système différencié d’autres notions, sans en faire seulement un cas limite, quasiment impensé. Le point de départ de l’étude est l’analyse de la triade ἀκούσιον/δι᾽ ἄγνοιαν/ἀγνοῶν qui convoque aux côtés du fou : l’homme en colère, l’homme pris de vin, celui qui dort, le méchant (μοχθηρός), l’intempérant/incontinent (ἀκρατής), le malade. Cela implique de déterminer les types d’ignorance en cause dans les actes accomplis dans chaque (...) cas et, a contrario, en contraste avec la position socratique, les différentes formes de «l’être dans le savoir» : le savoir en entéléchie première et le savoir en acte ; le savoir du général et celui du particulier ; le savoir en acte sans intervention des affections (πάθη) et le savoir avec affections. Dans l’ensemble des catégories d’acteurs envisagées qui, selon les cas ne mettent pas en acte leur savoir de la différence entre le bien et le mal temporairement, ou le font durablement au point de transformer leur ignorance un état stable (ἕξις) de méchanceté ou encore par choix, comme l’acratique, dans cet ensemble donc, le fou apparaît comme celui qui agit par ignorance (δι᾽ ἄγνοιαν) et non pas de l’un ou de l’autre des paramètres d’une action particulière, mais de tous, à l’exception d’un seul : l’agent car, dit Aristote, «comment s’ignorer soi-même» (ἑαυτόν). Un autre moment de l’article consiste à analyser ce qu’est le soi-même en question et conclut à la réduction de l’αὐτός à ce qui accompagne la mise en acte de l’existence (τὸ εἶναι) que ce soit dans l’agir (πραττειν), le faire (ποιεῖν) ou le vivre (ζῆν). Le fou, en agissant, activerait simplement son sentiment d’exister et en cela ne pourrait «s’ignorer lui-même». Mais il faudra qu’il sorte de cette position et que, revenu à la connaissance de tous les paramètres d’un acte, il se repente de ce qu’il a accompli, pour avoir droit à la qualification d’ἀκούσιος («qui a agi contre son gré»). Chez Aristote la folie semble donc ne pouvoir être philosophiquement prise en compte que comme une crise dont on sort pour mettre en acte son savoir des paramètres d’une action particulière et n’est pas excusable parce que le fou «n’aurait pas eu conscience de son acte» mais parce qu’il a retrouvé la connaissance de ce qui compose un acte. La conception de la relation sexuelle chez les anciens Grecs est dominée, selon Brisson, par l’opposition entre le rôle actif de l’homme et le rôle passif de la femme. Ils ne reconnaissaient pas l’opposition entre l’homosexualité et l’hétérosexualité considérées comme des états permanents et exclusifs, mais reconnaissaient seulement les cas d’homosexualité dans l’inversion des rôles actif et passif assignés à l’homme et à la femme. L’homme homosexuel était celui qui jouait le rôle passif en se maquillant et en se travestissant, (...) et la femme homosexuelle était celle qui jouait le rôle actif en se comportant comme un homme, en faisant du sport, par exemple. La bisexualité devenait ainsi homosexualité non pas dans la possession d’un organe sexuel ou d’un autre, ni même dans l’expérience de tel ou tel type de plaisir, mais dans le jeu des rôles actif ou passif qui définissaient l’homme et la femme. Ces rôles étaient transposés sur le plan social. Être un homme, c’était pour les Anciens, être un guerrier; être une femme, c’était être une épouse et une mère. Le refus de ces rôles sociaux chez l’homme comme chez la femme entraînait des doutes sur la possession effective du sexe biologique. Mais la bisexualité, une fois distinguée de l’homosexualité, portait en elle une idée très importante: celle du désir d’une fusion permanente qui se trouve impliqué dans toute relation amoureuse de nature hétérosexuelle ou homosexuelle. Comme cette fusion permanente entre deux corps est impossible, elle ne pouvait être atteinte qu’au niveau de l’âme, de sorte que l’individu devait s’identifier à un objet spirituel qui devenait l’objet suprême de son amour. C’est ce qui se passe dans le discours de Socrate qui suit celui d’Aristophane et qui, sous l’inspiration de Diotime, montre que l’immortalité ne passe plus par l’union des corps qui assure la survivance de l’espèce humaine, mais par l’union de l’âme avec un principe immatériel asexué. De plus, Brisson fait observer que les mythes anciens placent à l’origine des dieux, de l’univers et de l’homme des êtres bisexués qui se situent au-delà de toute distinction ou séparation entre les sexes opposés et qui assurent dans l’origine de tous les êtres, l’unité des contraires. Comme dans le mythe du Phénix, la bisexualité permet d’assurer la survie et la résurrection par autogénération. Par ailleurs, pour penser le rapport entre ces deux pôles, on doit supposer l’existence d’intermédiaires qui vont tantôt d’un côté et tantôt de l’autre. Un tel intermédiaire est assimilé à un daimon dans le discours de Diotime et l’on en trouve la figure mythique chez le devin Tirésias qui change de sexe au cours de son existence. (shrink)

For many epistemologists and normativity theorists, epistemic norms necessarily entail normative reasons. Why or in virtue of what do epistemic norms have this necessary normative authority? According to what I call epistemic constitutivism, it is ultimately because belief constitutively aims at truth. In this paper, I examine various versions of the aim of belief thesis and argue that none of them can plausibly ground the normative authority of epistemic norms. This book is one of the most important recent books on Hegel, a philosopher who has had a crucial impact on the shape of continental philosophy. Published here in English for the first time, it includes a substantial preface by Jacques Derrida in which he explores the themes and conclusions of Malabou's book. _The Future of Hegel: Plasticity, Temporality and Dialectic_ restores Hegel's rich and complex concepts of time and temporality to contemporary philosophy. It examines his concept of time, relating (...) it to perennial topics in philosophy such as substance, accident and the identity of the subject. Catherine Malabou's also contrasts her account of Hegelian temporality with the interpretation given by Heidegger in _Being and Time_, arguing that it is the concept of 'plasticity' that best describes Hegel's theory of temporality. The future is understood not simply as a moment in time, but as something malleable and constantly open to change through our interpretation. The book also develops Hegel's preoccupation with the history of Greek thought and Christianity and explores the role of theology in his thought. Essential reading for those interested in Hegel and contemporary continental philosophy, _The Future of Hegel _is also fascinating to those interested in the ideas of Heidegger and Derrida. (shrink)

Republican and so-called independence conceptions of freedom stand out from other conceptions by embedding strong modal conditions on what it takes for a person to count as being free to do something. For this reason, the extent of one’s freedom, conceived under republican/independentist lights, cannot be measured by any of the measures of freedom that have been developed so far in the literature on freedom, since these do not register the requisite modal constraints. In this paper I propose a measure (...) of freedom that does capture the requisite modal concerns. I do so by relying on work in the semantics of counterfactuals to define a measure of how modally robustly available an option is to an individual. (shrink)

While there is considerable support for integrating ethics education in accounting curricula, research presents conflicting evidence on how best to incorporate it. A review of accounting ethics scholarship highlights criticisms of the literature, including limited research into actual behavior and a lack of theory. We report the results of a study that is theory based, captures behaviors rather than attitudes, and explores the effect of repeated practice to develop voice efficacy. We examine the impact of two types of ethics instructions. (...) Across four classes in an accounting curriculum, one student cohort participated in traditional ethics instruction, while the other cohort participated in Giving Voice To Values instruction. We collected student responses to an ethical challenge and conduct a between-subject analysis. The results reveal consistent unethical behavior in the traditional cohort but not in the GVV cohort, indicating that faculty should consider the use of this pedagogy in accounting ethics education. According to epistemic deontologism, attributions of epistemic justification are deontic claims about what we ought to believe. One of the most prominent objections to this conception, due mainly to William P. Alston, is that the principle that ‘ought’ implies ‘can’ rules out deontologism because our beliefs are not under our voluntary control. In this paper, I offer a partial defense of Alston’s critique of deontologism. While Alston is right that OIC rules out epistemic deontologism, appealing to doxastic involuntarism is not (...) necessary for generating that tension. Deontologists would still have a problem with OIC if doxastic voluntarism turned out to be true or if deontologism did not require voluntarism. This is because, in short, epistemic justification does not imply ‘can’. If, as deontologists maintain, epistemic justification implies ‘oughts’, then epistemic justification must also imply ‘can’ given OIC. But since epistemic justification does not imply ‘can’, OIC dictates that we reject deontologism. I end by exploring the possible consequences of this incompatibility between OIC and deontologism. My conclusion is that at least one of the following claims must be true. Either ‘ought’ does not imply ‘can’, attributions of epistemic justification are not deontic claims, or epistemic claims lack necessary or categorical normative authority. (shrink)

Precision medicine research is rapidly taking a lead role in the pursuit of new ways to improve health and prevent disease, but also presents new challenges for protecting human subjects. The extent to which the current “web” of legal protections, including technical data security measures, as well as measures to restrict access or prevent misuse of research data, will protect participants in this context remains largely unknown. Understanding the strength, usefulness, and limitations of this constellation of laws, regulations, and procedures (...) is critical to ensuring not only that participants are protected, but also that their participation decisions are accurately informed. To address these gaps, we conducted in-depth interviews with a diverse group of 60 thought-leaders to explore their perspectives on the protections associated with precision medicine research. In the United States, the decision of whether to withdraw or continue to provide artificial nutrition and hydration (ANH) for patients in a permanent vegetative state (PVS) is placed largely in the hands of surrogate decision-makers, such as spouses and immediate family members. This practice would seem to be consistent with a strong national emphasis on autonomy and patient-centered healthcare. When there is ambiguity as to the patient's advanced wishes, the presumption has been that decisions should weigh in favor of (...) maintaining life, and therefore, that it is the withdrawal rather than the continuation of ANH that requires particular justification. I will argue that this default position should be reversed. Instead, I will argue that the burden of justification lies with those who would continue artificial nutrition and hydration (ANH), and in the absence of knowledge as to the patient's advanced wishes, it is better to discontinue ANH. In particular, I will argue that among patients in PVS, there is not a compelling interest in being kept alive; that in general, we commit a worse violation of autonomy by continuing ANH when the patient's wishes are unknown; and that more likely than not, the maintenance of ANH as a bridge to a theoretical future time of recovery goes against the best interests of the patient. In lieu of an abstract, here is a brief excerpt of the content:American Journal of Philology 1.1 (2000) 93-119 [Access article in PDF] Horace and His Fathers: Satires 1.4 and 1.6 Catherine Schlegel * Fere nulli alii sunt homines qui talem in filios suos habent potestatem qualem nos habemus. --Gaius Institutiones Iuris Civilis 1.55 No other ancient poet offers the sense of affectionate intimacy which Horace's "autobiography" in the Satires grants to his readers. 1 It is consequently with some (...) initial regret that readers recognize that Horace tells us very little about his life, 2 and that furthermore the "information" he supplies is motivated by its poetic context, rather than by the impulse which Horace beguilingly alludes to, of confessing his life to his books. Satires 1.4 and 1.6 are the well-known loci of Horace's upbringing by his father, told in the context of Horace's relation to Lucilius, his satiric forebear, and to Maecenas, the man conventionally known as Horace's patron. All four figures--father, son, satiric predecessor, and patron--are artifacts of the poet's generic construction, dramatis personae structured to provide a definition to Horace's satiric art. The freedman father who so famously raised his son, by hand as it were, serves to organize the relation between Horace and the two figures Horace makes to loom in his poetic life, Lucilius and Maecenas. Paired in their respective poems with Horace's father, Lucilius and Maecenas are given a fatherly relationship to Horace only to be displaced by the biological parent. More remarkably, Horace's biological father emerges from the poems as Horace's poetic father too, and this leaves Lucilius and Maecenas deprived of the poetically crucial role which they seemed bound to assume in the satire and life of the poet. These paternal maneuvers [End Page 93] in Satires 1.4 and 1.6 make the persona of Horace the poetic cause of his art, make the constructed "self" of Horace the unshakable source of his poetry, and secure a particular disposition for his satire. Although Horace appears to subordinate art to life, extracting the causes of his persona and his poetry from his father's training and social status, the eventual outcome works in reverse, and it is the poet's life which is subordinated to his art. Satire 1.4: Who is the Father of this Genre? It is especially important to recognize the artful selectivity of Horace's self-portrait in the Satires, because the satirist's persona emerges as a crucially defining element of the genre of satire for Horace. In Satire 1.4 he uses his own persona to explain, justify, and limit the satiric poetry he writes. Although he begins the poem by distinguishing himself from Lucilius stylistically, what evolves in the course of the poem is a contemplation of human character in which poetic style is only one outcome of that character. Horace's defense of his satire in 1.4 rests on a self-description couched in ethical, not poetic, terms. The merging of poetic style and personal character produces a picture of the satiric genre which is identified with the poet himself; the poetry is the inevitable outcome of the man. When Horace asks whether his poetry is justifiably suspectum (1.4.65), he answers by telling us who he is; the poet is the answer to the question about the genre. Style and ethos are thus made indistinguishable.That art can be wholly identified with its human source is in some sense a radical view, but it is nevertheless congenial to satire, a genre peculiarly fixed in the ordinariness of life, whose muse is, as Horace says later, pedestris. 3 Satire constantly finds its wisdom, parody, or bite in ordinary material reality, so Horace's strategy of equating the poem with its material cause, the poet, is perfectly consistent with the genre's [End Page 94] orientation. Faced with the present migrant crisis and the dismal record of Europe in protecting vulnerable refugees’ and migrants’ rights, what could be the view of the moral philosopher? The contrast between the principles enshrined in the European Charter of Fundamental Rights and the reality of present policies is shocking, but more scrutiny will show that it is the result of a larger trend towards an understanding of freedom mostly in economic terms, at a time when economists such as Amartya Sen (...) have revised their approach to economic growth and prosperity, noting the central role played by a much richer conception of freedom. The paper will scrutinize these inconsistencies and the conception of the person from which they derive and will provide an alternative and more coherent moral vision that could strengthen the legitimacy of the European Charter, at a time of growing dissatisfaction and so‐called democratic deficit. Such a vision could help reconnect the Charter with a conception of the human person as in need not solely of passive legal protection, but also of active promotion of her self‐respect and capabilities, and of her aspiration to a valuable life. Le sens du vêtement est construit par un système d’oppositions (toga pura VS toga praetexta ; toga VS stola, etc.) qui ne fonctionnent (...) qu’en contexte. Ainsi, le vêtement peut caractériser à la fois un statut, un rang (magistrat/non magistrat) et un état (citoyen en deuil, adolescent faisant son apprentissage oratoire, jeune mariée…), plus qu’il n’est l’apanage d’un sexe. En outre, les vêtements et la façon de les porter étant très codifiés, les transgressions ou variations par rapport à ce code sont toujours signifiantes et elles sont l’objet du regard et des commentaires des membres de la société. Background: There is an international trend for frail older adults to move to residential care homes, rather than ageing at home. Residential facilities typically espouse a person-centred philosophy, yet evidence points to restrictive policies and surveillance resulting in increased loneliness and diminished opportunities for intimacy and sexual expression. Residents may experience what has been termed social death, rather than perceive they are related to by others as socially alive. Aim: To consider how the loss of intimacy and sexuality in residents’ (...) lives contributes to iatrogenic loneliness experienced in residential care, and the importance of considering these issues together. Research design: The study utilised a constructionist methodology, investigating the meanings associated with intimacy, loneliness, and ageing. Participants and research context: Qualitative data used in this study are drawn from a larger dataset of a mixed-methods study. Interviews were completed as follows: staff, 21 individual interviews, and two groups with a total of 13 additional people; residents, 26 interviews with 28 people; and family members, 12 interviews with 13 people. Findings: Five key themes were identified in the data analysis: loneliness and relational identity, loneliness and functional relationships, loneliness and disrupted intimacy, loneliness and liminality, and loneliness and the built environment. Ethical considerations: The study was approved by a University Human Ethics Committee. Participation was voluntary. Consent was gained and confidentiality upheld. Discussion: Residents’ expression of intimacy and sexuality can be compromised through paternalism, ageism, restrictive policies, care-rationing and functional care, alienating residents from sustaining and developing significant relationships. Attitudes and cultural beliefs of staff and family members about ageing and intimacy, compounded by architectural design, may intensify loneliness. Conclusions: Nurses have a pivotal role in ensuring policies and practice enhance social citizenship. (shrink)
